Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Jiskta ESG Intelligence platform at esg.jiskta.com (the "Service"), operated by Jiskta. By creating an account, purchasing report credits, or generating a report, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Jiskta ESG provides automated environmental site assessments based on publicly available data published by the European Centre for Medium-Range Weather Forecasts (ECMWF) Copernicus Climate Change Service (C3S) and Copernicus Atmosphere Monitoring Service (CAMS), the European Environment Agency (EEA), and NASA. This service is intended for preliminary risk-screening purposes only.
2. Data Conduit Disclaimer
Jiskta is a data conduit, not a modelling firm or a certified environmental consultant. All outputs are derived from official, public third-party datasets. We do not modify, model, or interpolate source data beyond routine resampling and formatting.
Reports generated by this service constitute preliminary risk-screening data and must not be used as the sole basis for statutory CSRD disclosures or any regulatory filing without review and sign-off by a qualified environmental or ESG professional. Each generated PDF includes a prominent disclaimer to this effect.
You acknowledge and agree that reanalysis data is a modelled estimate of historical atmospheric conditions, not a direct measurement, and inherits the spatial resolution limits (0.1° ≈ 11 km) and temporal resolution limits (hourly) of the underlying CAMS and ERA5 models. We make no warranty, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any data returned by the Service.
3. Geographic Scope
This service is available exclusively to users and for facilities located in the European Economic Area (EEA) and the United Kingdom. We do not offer this service to users in the United States, Canada, or other non-EEA countries. If you access the Service from outside the EEA/UK, you do so at your own risk and we make no warranty that the service, data, or report format is fit for purpose under any regulatory framework outside the EU.
4. Acceptable Use
You must not use the Service to:
- Redistribute or resell generated reports or underlying data as a standalone data product;
- Share, sell, or transfer your account credentials to any third party;
- Use the Service for any purpose that violates applicable law.
5. Report Credits, Payments & Refunds
Report credits are prepaid via Paddle, our payment processor and Merchant of Record. Your payment contract is with Paddle.com Market Limited, which handles VAT collection and remittance on our behalf. A Paddle invoice is issued automatically after each purchase.
- Credits do not expire.
- Credits are non-refundable once a report has been generated.
- Right of withdrawal — waiver. The Service is a digital service that begins performance immediately upon purchase. By confirming a purchase you expressly consent to immediate performance and acknowledge that you thereby lose your 14-day right of withdrawal under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU).
- We reserve the right to modify pricing for future credit purchases; existing credits are not affected by pricing changes.
- If you believe credits were deducted in error, contact us at [email protected] within 30 days.
6. Data Sources & Attribution
When publishing results derived from reports generated by this Service, you are responsible for crediting the original data providers:
- Air quality (NO₂, PM2.5, PM10, O₃): Copernicus Atmosphere Monitoring Service (CAMS) — Copernicus Open Data Licence.
- Meteorological data (temperature, precipitation, wind): ERA5 reanalysis, ECMWF — Copernicus Open Data Licence.
- Industrial facilities: European Pollutant Release and Transfer Register (E-PRTR), European Environment Agency — CC BY 4.0.
- Water risk: WRI Aqueduct 4.0 (2023), World Resources Institute — CC BY 4.0.
- Fossil CO₂: ODIAC2024, National Institute for Environmental Studies (NIES) — CC BY 4.0.
- Protected areas: EEA Natura 2000 network — CC BY 4.0.
- Geocoding: OpenStreetMap contributors — Open Database Licence (ODbL).
7. Limitation of Liability
To the fullest extent permitted by applicable law, Jiskta and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Service or any report generated by it, including but not limited to loss of profits, business interruption, or any decisions made on the basis of report data. Our total aggregate liability for any claim shall not exceed the total amount you paid for the report credit(s) in question.
8. Privacy
The addresses and coordinates you submit are used solely to generate your report. We do not sell or share your data with third parties except as required to deliver the Service (Supabase — EU hosting, Paddle — payment processing).
9. Changes to Terms
We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Belgium. If you are a consumer in the EU, you retain any mandatory protections granted by the laws of your country of residence.
